Terms of Use
Effective date: October 16, 2026
These terms govern your use of fishdatapoint.com (the "site"), run by FishDataPoint ("we", "us"). By using the site you agree to them. If you don't agree, please don't use the site.
1. What the site is
FishDataPoint is a free planning aid. It combines:
- calculated sun and moon times and solunar "fishing windows"
- NOAA tide predictions
- official NWS alerts
- model weather and sea-condition forecasts
- lake levels where available
- notes about reviewed fishing places
Everything on the site is general information, provided for planning only.
- Fishing windows are a planning convention, not a prediction that fish will bite. We make no claim about catch success. See methodology.
- Tide heights are predictions at a named station, not live measurements at your spot.
- Weather and sea conditions are model forecasts, not observations, and they can be wrong.
- Data can be late, missing, stale or wrong, including because of problems at our providers.
2. Safety: not a safety, navigation or regulatory tool
Do not rely on FishDataPoint for your safety, for navigation, or to know the rules. Conditions on and near the water can change quickly and can be dangerous.
- Not for safety decisions. The site does not assess whether conditions are safe. A "best" window, a calm-looking forecast or the absence of an alert on our site doesn't mean it is safe to go out.
- Check official sources before you go:
- National Weather Service forecasts, warnings and marine forecasts
- U.S. Coast Guard notices
- local lifeguards, harbor masters and posted signs
We show some official NWS alerts, but if our alert service can't be reached the page says "Alert status unknown". That never means there are no alerts.
- Not for navigation. Don't use our tide charts, maps or coordinates to navigate. Use official NOAA products and nautical charts.
- Know the rules yourself. You're responsible for:
- fishing licences (and when they're not needed), report cards, bag and size limits, seasons, gear rules
- Marine Protected Areas and closures
Rules change. Check the California Department of Fish and Wildlife and, for Lake Tahoe, the Nevada Department of Wildlife. Our place notes link to the authority but don't replace it.
- Before you eat your catch, check fish-consumption advice from OEHHA and any posted advisories.
- Hazards are real. Waves, rip currents, sneaker waves, slippery rocks and piers, cold water, changing weather and lake levels can all injure or kill. You alone are responsible for your decisions and your safety, and for anyone in your care.
- In an emergency, call 911, or the U.S. Coast Guard on VHF channel 16.
3. Access, places and private property
Access, hours, parking and pier or ramp status can change without notice. Follow posted signs and the instructions of the operator (city, port, park, water district or land manager). Listing a place on our site is not permission to enter private property or a restricted area. Coordinates for searched places are town centres or your own rounded location, not verified fishing spots.
4. Free service; changes and availability
The site is free. We may change, suspend or discontinue any part of it at any time, including features, places, data sources and these terms, without notice or liability.
5. Your use of the site
You may use the site for your own personal, non-commercial planning, and share links to it. Downloads (.ics and PDF) are for your personal use.
6. Acceptable use
Please don't:
- scrape the site, or access it in bulk or by automated means (bots, crawlers, scripts), except standard search-engine crawling that follows our robots.txt
- use our pages or code to send bulk or automated requests to the data services we use (Open-Meteo, the National Weather Service, USGS, NOAA). They have their own terms and limits
- overload the site, or try to bypass rate limits, access controls or security measures
- use the site or its data to build a competing service, or republish our pages or data as your own
- interfere with the site, or use it for anything unlawful
We may limit, block or rate-limit requests or visitors that put the service or our data providers at risk.
7. No warranty
THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FISHDATAPOINT AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS, PERSONAL INJURY, PROPERTY DAMAGE OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF, OR RELIANCE ON, THE SITE OR ITS INFORMATION, including decisions about fishing, boating, travel or safety. Our total liability for any claim relating to the site is limited to US $50. Some jurisdictions don't allow certain limitations; in those places, these limits apply to the fullest extent allowed.
9. Indemnity
To the extent permitted by law, you agree to indemnify and hold FishDataPoint and its operator harmless from claims arising from your misuse of the site or your breach of these terms.

14. General
If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver. These terms and our privacy policy are the whole agreement between you and us about the site.
